Heard on I.A. No. 1 which is an application for condonation of delay.

For the reasons assigned in the said application for condonation of delay and the same found to be satisfactory, I.A. No.1 is allowed. The delay of 102 days in filing the present Cr.M.P. is condoned.

Also heard on admission.

Taking into consideration the appeal has been preferred against an order whereby the original complaint case has been dismissed for want of prosecution, this Court is of the opinion that an arguable case has been made by the Petitioner.

Accordingly, the present Cr.M.P. is allowed.

The Registry is directed to register the same as acquittal appeal.

The Acquittal appeal is admitted for hearing.

Notice be issued to the Respondent on payment of process fee as per rules.

Meanwhile, call for the records of the Court below and the matter be listed for final hearing after the records are received.
