Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 09/01/2017 After arguing for sometime, learned counsel for the applicant seeks to withdraw this application at this stage. He, however, submitted that the Trial Court be directed to expedite the trial as the applicant is in jail since 29/10/2016.

Considering the submission, this application is rejected, however, with a direction to the Trial Court to expedite the trial to ensure that the trial is completed as early as possible, as only 10 prosecution witnesses have remained to be examined.

If the trial is not completed within a reasonable time without there being any fault on the part of the applicant, he would be at liberty to revive this application.
