The counsel for the petitioner prays for withdrawal of the Writ Petition reserving his right to challenge any promotion given to any of the junior to the petitioner superseding the petitioner.

However, it is made clear that the pendency or withdrawal of the Writ Petition by itself should not preclude the State Government from considering the case of the petitioner for grant of promotion in its usual course in accordance with his rank in the gradation list. 3.

The Writ Petition accordingly stands dismissed as withdrawn with the aforesaid observation and liberty.
