Learned counsel for the appellant submits that the appellant may be permitted to withdraw this appeal with liberty to file an appropriate application before the Court below under Order 9 Rule 13 of Code of Civil Procedure (for short 'C.P.C.'). He further submits that Court below be directed to ignore the point of limitation while considering the application to be filed by the appellant under Order 9 Rule 13 of C.P.C.

Learned counsel for the respondent submits that let the appellant file all the applications before the Court below and direction be given to the Court below to decide the same in accordance with law.

The appellant is permitted to withdraw the FAM with the aforesaid liberty.
