The present writ petition has been filed by the Petitioner, seeking for a direction to the Respondents to consider the case of the Petitioner for grant of Time Bound Pay Scale as per the rules governing the service conditions of the Petitioner.

Counsel for the Petitioner submits that in the instant case notices were issued to the Respondents as early as on 13.12.2016 but till date the response of the Respondents has not been filed. He further submits that the Petitioner in the instant petition is at the fag-end of his service and is likely to retire in a couple of months time and therefore the present writ petition may be disposed of with a direction to Respondent No.1 to consider the case of the Petitioner in respect of entitlement of Time Bound Pay Scale if rules so permit.

State Counsel does not oppose the said proposition put forth by the Counsel for the Petitioner.

Accordingly, the present writ petition stands disposed of, with a direction to Respondent No.1 to personally look into the grievance of the Petitioner and to pass an appropriate order within a period of two months from the date of receipt of certified copy of this order. In case, Respondent No.1 reaches to the conclusion that the Petitioner is entitled for the benefit then the same shall be released to the Petitioner forthwith so that his retiral dues can be fixed in terms of revised pay-scale that he would be entitled for. It shall be the responsibility of the Petitioner to furnish the certified copy of this order to Respondent No.1.

With the aforesaid direction, the present writ petition stands finally disposed of.
