For the reasons assigned in the application and found them to be satisfactory, IA No.1 is allowed and delay of 292 days in filing petition is condoned.

Taking into consideration the reasons assigned in the petition and considering the fact that leave is sought for against the order whereby the complaint application under Section 138 of Negotiable Instruments Act has been dismissed for want of prosecution, this court is of the opinion that sufficient ground has been shown for grant of leave to appeal. Accordingly, the petition is allowed. Registry is directed to register this case as an Acquittal Appeal.

The Acquittal appeal is also admitted for hearing. Let notice be issued to the respondent by usual mode as well as by registered mode. PF within 7 days. List it for further consideration after service is complete on the respondent.
