Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/04/2021 Heard.

1. The applicants have been arrested in connection with Crime No.556 of 2019 registered at Police Station- Kota, District Bilaspur (CG) for the alleged commission of offence under Section 302, 34 of IPC.

2. Both the bail applications are being disposed off by this common order as they arise out of the same crime number.

3. The allegation against the applicants are that the applicants committed murder of deceased Upasana by pouring kerosene on her.

4. Learned counsel for the applicants would argue that earlier bail application of

-2Smt. Keju Bai was rejected by this Court and she was granted liberty to revive the application. Now some of the witnesses including the parents of the deceased have been examined and they have not supported the case of the prosecution as according to them it was a matter of accident.

5. On the other hand, learned State counsel opposes the bail application and submits that the evidence collected shows that the deceased died of burning and kerosene was found on her body.

6. This Court had already rejected the bail application of Smt. Keju Bai earlier.

7. Considering the material on record, particularly taking into consideration the gravity of allegation and that number of witnesses have been examined, it is directed that the Trial Court to conclude the trial as early as possible. The bail applications are rejected.
