Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 26-04-2018 in connection with Crime No.96/18 registered at P.S. - Devendra Nagar, Raipur, Chhattisgarh for the offence under Section 420, 467, 468, 471/34 of the IPC. 2.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. He is in jail since 26-04-2018. Charge sheet has been filed after completion of the investigation. No case is made out against this applicant. Hence, it is prayed that the applicant may be granted regular bail.

Learned counsel for the State/non-applicant opposes the application submitting that this applicant is the beneficiary of the fruits of the offence committed in this case. Hence, he is not entitled for grant of bail. 4.

Heard learned counsel for the parties and perused the case diary. 5.

The case against the applicant is this, that the property, which was already mortgaged to UCO Bank and the same was occupied by the UCO

-2Bank because of non-payment of loan, was again presented as fresh property and forged document was filed before the Grih Finance Ltd. for obtaining a loan of Rs.40,00,000/-. Later on, the complainant came to know about the fraud committed and the FIR has been lodged in this case. 6.

Considered on entire material present in the case diary and looking to this fact that now charge sheet is filed and the trial against the applicant is likely to take some time before its conclusion, I feel inclined to grant regular bail to this applicant.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
