1. The contempt petition has been filed alleging dis-obedience of the order dated 11.02.2019 passed in Writ Petition (s) No. 854/2019. The Counsel for the respondents on entering appearance has submitted their response. Along with response, they have also enclosed documents by which the respondents have been able to show details of the proceedings which took for releasing of unpaid pension and gratuity to the petitioner.

2. The facts that the petitioner has subsequently received the entire dues is not in dispute, the only claim of the petitioner was in respect of non granting of interest. Now so far as granting of interest is concerned, this Court had specifically directed to consider whether there was any deliberate delay on the part of the respondents for releasing the retiral dues or not. The respondents along with reply have produced certain documents which show that regular correspondences being made between department and the petitioner

-2so far as final settlement of the retiral dues are concerned. There were certain formalities required to be fulfilled which would enable the department for releasing the same.

3. All these correspondences and explanation provided by the department show that there does not seem to be any deliberate lapse on the part of the respondents for not releasing remaining of the dues promptly.

4. Given the facts, this Court is of the opinion that the order dated 11.02.2019 stands complied with and the contempt petition accordingly stands disposed of. However, it is made clear that in case, if there is still any unpaid amount left towards the petitioner, he would be at liberty to claim the same afresh from the department by making suitable representation and also for filing an appropriate fresh petition, if he so wants.
