This is repeat bail application. Earlier bail application stood rejected on merits on 30.11.2017 (MCRC NO.5858 of 2017). 2.

The ground raised by the applicant for grant of bail is that there is no substantial progress in the trial and the applicant is unnecessary languishing in jail for more than one and half years since 03.02.2017 onwards.

The State counsel however opposing the application submits that the bail application of the applicant has already been considered by this court and rejected on merits on 30.11.2017 and no substantial change in circumstances has been explained by the applicant for grant of bail. Therefore, prays for rejection of the bail application. 4.

Considering the gravity of the offence; taking note of the fact that the prosecutrix was a minor and also considering the observations made by this court in its order dated 30.11.2017, this court is not inclined to release the applicant on bail at this juncture.

However, the trial court is directed to ensure that trial is concluded at the earliest and shall also ensure that witnesses are produced before the court by the prosecution agency without fell on each date of hearing.
