Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/02/2021 Heard.
1. The applicant has moved this application for grant of bail as he is arrested in connection with Crime No.51/2019 registered at Police Station- Passan, District : Korba, C.G. for the offence under Sections 148, 302/149 & 201 of IPC.
2. Prosecution case is that the applicant assaulted with the help of an axe on the head of the deceased resulting in his death. The body was buried which was found after some time.
3. Learned counsel for the applicant submits that the involvement of the applicant is based only on the suspicion and till date out of 25 witnesses, 7 witnesses have been examined who have not supported the case of the prosecution, therefore, at this stage, the applicant may be granted bail.
4. On the other hand, learned State Counsel opposes and submits that the applicant is being tried commission of grave offence of murder and many important witnesses are yet to be examined.
5. Taking into consideration the submissions of learned counsel for the parties, at
this stage, I am not inclined to grant bail to the applicant, however, in case, there is no material progress in trial in next three months, the applicant would be at liberty to revive.
