Learned counsel for the petitioner submits that fake complaint was made saying that oral consent was given to give paddy apart from the written agreement and on that basis FIR was registered, which is completely fake as there is no system existing in custom milling for entering into oral agreement for the paddy but ignoring the same, the FIR was registered in the year 2015 and still the same is being carried out without any closure report, therefore, the State be directed to file the closure report and closed the case. 2.

At this stage, this Court is not going to enter into the merit of this case as to whether the charge is made out or not, however, if the FIR is made then the police is obliged to complete the investigation within a stipulated period of time, which cannot be kept for time immemorial.

Under the facts and circumstances of the case and taking into the submission made, it is directed that the police shall complete the

investigation within a specified time or shall free to file closure report or challan as the case may be in accordance with law within a further period of six months.
