27.10.2020 Heard

1. Learned counsel for the petitioner would submit that the petitioner has been transferred from the office of Veterinary Hospital Sarsiwa, District Baloda Bazar to the office of Veterinary Hospital Jhint, Block Patan, District Durg on 14.09.2020. He would submit that the petitioner is a President of Chhattisgarh Sahayak Pashu Chikitsha Kshetra Adhikari Sangh and he was elected on 05.12.2019. Therefore, as per the policy, the petitioner being the President, he would be exempted to be transferred which would be evident from Annexure P-3 dated 24.06.1996.

2. Learned State counsel would submit that how long the petitioner is working at Sarsiwa, District Baloda Bazar has not been pleaded.

3. Perused the letter of the Chhattisgarh Sahayak Pashu Chikitsha Kshetra

Adhikari Sangh which purports that the petitioner has been declared as President of the Union for 3 years on 05.12.2019 and as per the policy of the State, the President or the Secretary would be exempted from transfer for 3 years. Considering this factual aspect, to ascertain the same, the petitioner is given liberty to make a representation before the respondent No.2 / Director, Veterinary Services Raipur within a period of 3 weeks ventilating all the grievances and if such representation is filed, the same shall be decided within a period of 45 days. Till the factual aspect is made clear in the representation, the transfer order dated 14.09.2020 (Annexure P-1) in respect of the petitioner shall not be given effect to.
