This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.77/2015, registered at Police Station Jhilmili, Civil and Revenue District Surajpur (C.G.), for the offence punishable under Sections 363/366/376 of I.P.C. read with Section 4 of Protection of Children from Sexual Offence Act.

The applicant's first bail application was dismissed as withdrawn vide order dated 18/08/2015 in M.Cr.C. No. 4089/2015.

After hearing learned counsel appearing for the parties and having gone through the case diary; statement of the prosecutrix recorded in the Court and statement of Smt. Indrakunwar, mother of the prosecutrix, this Court is not inclined to release the applicant on regular bail; therefore, this second bail application is rejected. However, the trial Court is directed to expedite the trial.
