Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/05/2017 This contempt petition has been filed by the petitioner alleging that despite clear direction for consideration of cases of promotion within a period of six months, till date, no decision has been communicated to the petitioner. I find that under communication dated 20/01/2017 of Jila Panchayat, it has been informed that the matter was taken after the order was passed by this Court and because of some instructions issued by higher authorities and nonavailability of posts earmarked to the Jila Panchayat, petitioner's case could not be considered.
Taking into consideration the contents of aforesaid letter, I am not inclined to say that it is a case of willful disobedience by the authorities. However, if the petitioner feels that the reason assigned could not be a ground to withhold consideration, he may seek appropriate direction in a separately constituted petition.
