Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/05/2017 This petition has been filed by the petitioner aggrieved by letter dated 22/04/2017 of the Superintendent of the Medical College of Raigarh, by which, the petitioner has been asked to vacate the quarter occupied by the petitioner. 2.

Learned counsel for the petitioner submits that the Collector had allotted the residential quarter to the petitioner on 17/06/2015 and the petitioner was also entrusted work in the Government's scheme of Save Girl Child- Educate Girl Child vide letter dated 04/07/2016. It is next submitted that the Collector alone was competent to cancel petitioner's allotment. 3.

On the other hand, learned State counsel, upon instructions, submits that the quarter, which was allotted to the petitioner by the Collector, is within the premises of the Medical College and preference is to be given to the residence of

the doctors of the Medical College to facilitate their presence in the Medical College and hospital. The petitioner is working with the Municipal Corporation. Therefore, the petitioner may apply to the Collector for allotment of quarter at any other place.

Quarters, within the control of the Director, Medical Education, are required to be given on preferencial basis to the doctors who are attached with the medical college. The petitioner may have been alloted quarter by the Collector, but once, Medical College requires accommodation, the petitioner cannot continue, particularly when, he is not presently working with the Medical Education Department nor associated with the Medical College or hospital but with the Corporation.

Therefore, no relief can be granted to the petitioner. The petition is accordingly dismissed.
