1. After arguing at length, learned Counsel for the Applicant submits that he wants to withdraw the instant application with liberty to file a fresh application under Section 439 of Cr.P.C. before the Trial Court.

2. In view of the above submission, the instant application is dismissed as withdrawn with the aforesaid liberty. The Trial Court shall decide the proposed applicant under Section 439 of Cr.P.C. preferably on the date of its submission.
