Hon'ble Shri P. Sam Koshy, J Order On Board 18.09.2015 The grievance of the Petitioner is to the order dated 17.12.2012 whereby the earlier order of transferring the Petitioner from Government Boys Higher Secondary School, Ambagarh Chowki, Distt. Rajnandgaon to the Office of Block Education Officer, Ambagarh Chowki, Distt. Rajnandgaon has been cancelled. 2.

The Petitioner, by way of an interim order passed by this Court on 9.1.2013, has obtained an interim protection whereby, he has been permitted to continue at the place of posting where he has been transferred on 28.7.2012. Since the Petitioner remained at the said place of posting for more than three years and by efflux of time, the interim order has also got absolute. 3.

The State counsel, at this juncture on instructions, makes a submission that they do not want to press the impugned order so far as the Petitioner is

concerned any further and the petition may be dismissed as having become infructuous.
