1. Grievance of the Petitioner is against the order dated 30.07.2012 whereby the Petitioner has been transferred from Jagdalpur to Kondagaon on administrative exigency.

2. The said order was already stayed by this Court in W.P. (S) No. 3319 of 2012 while disposing of the said petition on 21.08.2012, giving an interim protection till the representation of the Petitioner is decided. However, the State Government vide its order dated 29.12.2012 rejected his representation which has been again challenged by the Petitioner by a way of present Writ Petition. On the basis of the interim protection issued in W.P. (S) No. 3319 on Order dated 21.08.2012 the Petitioner still continues to discharge his duties at Jagdalpur.

3. Learned Counsel for the State today makes a submission that they do not wish to enforce the impugned order so far as the Petitioner is concerned. However, Counsel for the State prays for liberty that in case if need so arises they may pass a fresh order.

4. In the light of the statement made by the Counsel for the State nothing further remains to be adjudicated upon in the present Writ Petition.

5. With the aforesaid liberty the Writ Petition is dismissed as has become infructuous.
