Suit filed by respondnet-State Bank of India was decreed granting decree in favour of the Bank and against the petitioner/judgment debtor for a sum of Rs.2,14,700.22 along with 12.5% interest.

Learned counsel for the petitioner would submit that execution is pending before the Executing Court, but the Executing Court has exceeded its jurisdiction in issuance of attachment warrant as the petitioner has raised his dispute before the Banking Lokpal for redressal of his grievance.

Since, decree has been passed by the Executing Court and amount is recoverable against the petitioner, proceeding cannot be stayed till the decision of the Banking Lokpal. I do not find any error of jurisdiction in the order impugned.

Accordingly, the writ petition deserves to be and is hereby

dismissed. No order as to cost(s).
