Learned counsel for the petitioner submits that the earnest money deposited by the petitioner is not being refunded to him by the respondents. 2.

Learned State counsel submits that being an arbitral dispute as Clause 29 provides for the arbitration in an agreement entered into between the parties, the writ petition is not maintainable. 3.

Since, the dispute being contractual dispute in nature and the agreement entered into between the parties contains an arbitration clause, this Court is not inclined to entertain this writ petition. However, this will not

bar the petitioner to invoke the remedy available under the law. 4.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
