The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 08/2014 registered in Police Station Mahila Thana, Ambikapur, District Surguja (C.G.) for offence punishable under section 376, 341, 294 & 506-B of Indian Penal Code, 1860. 2.

It is a case of bail jump. As per the order applicant was granted bail in Crime No.08/2014 registered in Police Station Mahila Thana, Ambikapur, District Surguja (C.G.) for offence punishable under section 376, 341, 294 & 506-B of Indian Penal Code and subsequently during the trial he jumped the bail on 24/04/2015 for which arrest warrant was issued and he was arrested.

Learned counsel for the applicant submits that the applicant was earlier granted bail but due to the ailment he could not appear on 24/04/2015. Subsequently, he was arrested. It is further submitted that applicant appeared on each and every date and only on one date he jumped the date, therefore, the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Having regard to the fact that applicant was earlier granted bail and he is in jail since 12/11/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
