Present revision has been preferred against the order dated 14.10.2015 passed by the Principle Judge, Family Court, Raipur in Criminal M.J.C. No. 419/2011 whereby the Family Court has directed the applicant to pay Rs.2,000 to respondent no.1 and Rs.1,000 to respondent no.2 per month as maintenance.
Counsel for the applicant submits that respondent no.1 is the wife and respondent no.2 is daughter of the applicant and both are staying at the parental home of respondent no.1 and that the financial condition of the applicant is not sound enough for paying an amount of Rs.3,000 per month to the respondents as maintenance and hence, the impugned order is bad in law.
A perusal of the order of the Court below clearly reflects that in his evidence, the applicant himself had admitted that he was not interested to keep the respondents with him. Considering the total facts and circumstances of the case and also taking into consideration the entire factual matrix of the case and the income of the applicant, this Court is of the opinion that the Court below has not committed any illegality in reaching to the conclusion of awarding Rs.2,000 per month
to respondent No.1 and Rs.1,000 per month to respondent No.2 as maintenance particularly looking to the present day cost of living. Accordingly, the revision petition being devoid of merits is dismissed.
