Shri KPS Gandhi, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 08/01/2021 Learned counsel for the appellant, at this stage, submits that the appellant is willing to surrender and apply for grant of regular bail as the co-accused Shailendra Singh has been granted regular bail by this Court on 12/10/2020 in Cr.A.No.658/2020. He would submit that in the circumstances, as the appellant is claiming regular bail on parity with the co-accused Shailendra Singh, the Court below may be directed to decide his bail application on the same day.

Learned State counsel and counsel for objector state no objection to withdrawal.

Accordingly, the appeal is dismissed as withdrawn with liberty to move application for grant of regular bail after surrender before the Court below. The Court below shall make all endeavor to decide the application on the same day, if possible, in any case, within three days.
