The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 165/2015 registered in Police Station Mana Camp, Raipur, District Raipur (C.G.) for offence punishable under section 457, 380, 381, 34 of IPC.

As per the prosecution case, in between the intervening night of 67/09/2015 cash amount of Rs.1 lakh was stolen from M.M. Industries Pvt. Ltd. Situated at Dumartarai and on the suspicion when enquiry was made present applicant was arrested. On the memorandum statement of the applicant and other co-accused cash amount of Rs.95,040 was recovered from different places.

Learned counsel for the applicant submits that charge sheet in this case has been filed and the applicant is in jail since 7/09/2015 and there is no direct evidence is available against this applicant. He further submits that similarly placed co-accused has been enlarged on bail in M.Cr.C. No.6511/2015 on 1/12/2015, therefore, the applicant may be released on

bail.

Learned State counsel on verification do not dispute the fact that similarly placed co-accused has been enlarged on bail in M.Cr.C. No.6511/2015 on 1/12/2015.

Having regard to the fact that similarly placed co-accused has been enlarged on bail in M.Cr.C. No.6511/2015 on 1/12/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
