Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 16/05/2017 Heard.
1. By this petition, the petitioner assails correctness and validity of the order passed by the Collector, District Durg way back on 27.12.2012 by submitting that licence of the Society for running fair price shop was suspended till election of Society President.
2. Learned counsel for the petitioner submits that order was bad because the Registrar vide his memo dated 10.2.2012 had informed regarding the office bearers, which shows that there is no dispute.
3. It appears that even though the licence was suspended in the year 2012, the
-2petitioner did not approach this Court and the documents on record show that the petitioner had been making representations in various fora.
4. The petitioner having not raised the dispute before this Court within a reasonable time, no relief can be granted by the writ Court. Therefore, the petition is liable to be dismissed only on the ground of delay and laches and is accordingly dismissed.
5. This order would not come in the way of the petitioner in pursuing representation on such grounds as may be available to him including the fact that the Society President has been duly elected. Sd/-- (Manindra Mohan Shrivastava) Judge Praveen
