1. Learned State counsel submits that the petitioner has challenged the impugned notice in W.P.(C)No.489/2016 which has been dismissed on 22-2-2016 giving liberty to the petitioner to file appeal which the petitioner has not filed and again filed this second petition which is not maintainable.

2. Learned counsel for the petitioner submits that the Sub-Divisional Officer (Revenue) has demolished the petitioner's house, therefore, appeal cannot be maintained.

3. This Court had dismissed the writ petition granting liberty to the petitioner to prefer appeal before the Sub-Divisional Officer

(Revenue). The State counsel also submits that the Sub-Divisional Officer (Revenue) has now changed and therefore, the petitioner can prefer appeal before the present Sub-Divisional Officer (Revenue) with an application for condonation of delay.

4. Be that as it may, if appeal is preferred by the petitioner before the competent authority, the competent authority will do well and dispose of the appeal expeditiously, in accordance with law. The petitioner may make an application for stay/interim order before that authority.

5. With this observation, the writ petition stands finally disposed of. No order as to costs.
