Hon'ble Shri Justice Gautam Chourdiya Order On Board 28/09/2021 1) Heard.

2) Both the aforesaid applications are being disposed of by this common order.

3) Applicant has filed these First Bail Applications under Section 439 of Code of Criminal Procedure, 1973 for grant of bail as applicant is in jail since 09/05/2021 in connection with Crime No. 55/2021 & 56/2021 registered at Police Station Kunkuri, District Jashpur (C.G.) for the offence under Sections 457, 380/34 of Indian Penal Code. 4) At the outset, learned Counsel appearing for the State submits that apart from the present Crime Numbers, the applicant has as many as 03 criminal antecedents i.e. Crime No. 128/2019 & Crime No. 150/2019 under Section 379/34 of Indian Penal Code of the 2019 and Crime No. 23/2020 under Section 457, 380, 511 of Indian Penal Code of the 2020, registered at Police Station Kunkuri, District Jashpur (C.G.).

5) In view of above, learned Counsel for the applicant seeks to withdraw both the applications with liberty to file afresh as and when occasion arises.

6) Accordingly, the both the applications are dismissed as withdrawn with the liberty as stated above.
