1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.77/2015, registered at Police Station Masturi, Distt. Bilaspur, for the offence punishable under Sections 4, 6, 10 of the Krishak Pashu Parirakshan Adhiniyam, 1959, Sections 3 and 11 of the Pashu Krurta Adhiniyam, 1960.

2. Case of the prosecution, in brief, is that the applicant and two other co-accused persons were found transporting 34 scheduled agricultural animals on 4-3-2015 and thereby committed the offence.

3. Learned counsel for the applicant would submit that the applicant has not committed any offence and he has been falsely implicated in the case, as there is no evidence against the applicant for the aforesaid offence, neither he is owner of the vehicle nor is owner of the cattle. The applicant is in jail since 18-8-2015 and charge-sheet has been

filed.

4. On the other hand, learned State counsel would oppose the application.

5. I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the nature and gravity of offence, facts and circumstances of the case, evidence available against the applicant who is said to have been transporting the above said cattle for the purpose of slaughtering, I am not inclined to grant bail to the applicant.
