Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 15/05/2017 Heard.

The petitioner's grievance is that the petitioner's application for renewal of FL3 license for the year 2017-18 has remained pending. It is the assertion of the petitioner that the premises in which FL-3 license, is being situated at a distance of more than 500 mtr. from National Highway Authority. 2.
Presumably because of inquiry being made towards compliance of the order of the Hon'ble Supreme Court in the case of State of Tamil Nadu represented by its Secretary Home, Prohibition and Excise Department and Others Vs. K. Balu and another, (2017) 2 SCC 281, the application of the petitioner has remained pending. Therefore, in these circumstances, it would be appropriate to direct the Licensing authority to examine the petitioner's application and then pass appropriate orders on the same in accordance with law as early as possible preferably within a period of safe 30 days from the date of receipt of copy of this order. 3.
Accordingly, the petition is disposed off.
