Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 17/05/2017 Heard.

This petition has been filed by the petitioner seeking a mandamus to quash order dated 01.04.2017 by which the Collector has constituted a Special Investigation Team on certain allegations against the petitioner. 2.

What brings the petitioner to this Court is the apprehension that somehow or the other the petitioner may be subjected to a vindictive action because earlier the Collector got inquiry made through Sub-Divisional Officer, Katghora, who submitted inquiry report in favour of the petitioner vide memo dated 29.03.2017. Even then, the Collector has not closed the matter and has now constituted a committee.

It appears that presently the matter is under inquiry on certain allegations. The result of the inquiry would take shape only when the inquiry is completed and report is submitted before the Collector.

If any order adverse to the interest of the petitioner is proposed to be passed, law would require an opportunity of hearing to the petitioner on any proposed action in the event of there being any adverse report. At that stage, the petitioner may raise all the grounds which may be available to him to safeguard his interest.

With this protection at this stage, no further observations are required to be made and the petition is disposed off.
