Heard By an order dated 14.08.2015, this Court had directed to evaluate the documents filed under Order 41 Rule 27 of C.P.C. during the course of appeal to adjudicate the bonafide of the parties.
The application is filed and since the case has been remanded, those documents which have been placed here could not be procured, therefore, the document filed here under Order 41 Rule 27 be sent to the Trial Court to adjudicate it and adduce evidence on that.
Considering the facts, the Registry is directed to return the documents filed along-with copy of the application under Order 41 Rule 27 of C.P.C., which was filed before this Court, after retaining the copy of the documents.
With such observation, the petition stands disposed off.
