Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 16/05/2017 Heard.

Though number of grounds have been urged to assail the legality and validity of order dated 18.10.2016, considering that there exists a remedy of revision before the Tribunal and no specific ground of want of jurisdiction of the authority appears on record, I am not inclined to entertain this petition without insisting on exhaustion of alternative remedy. Therefore, the petition is dismissed with liberty to file revision before the competent authority.

Learned counsel for the petitioner submits that the petitioner has an apprehension that the appeal may not be decided expeditiously. At this stage, the apprehension of the petitioner is not well founded. For any reason, if the appeal of the petitioner is not decided, the petitioner can always bring to the notice of the Court.

Certified copy of the impugned order (Annexure P/1) be returned after retaining photocopy of the same. The time, during which, this petition has remained pending before this Court, may be claimed to be excluded from the purview of limitation. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
