The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 54/2015 registered in Police Station Pandri Mova, District Raipur (C.G.) for offence punishable under section 392, 120-B of Indian Penal Code & Section 25, 27 Arms Act (wrongly mentioned as IPC).

As per the prosecution case on 26/02/2015 at about 1.45 pm, the applicant along with other co-accused persons committed robbery and looted an amount of Rs.12,77,000/- from Satyanarayan Moorthi, who was working as O.S.D. to the Director, Narayana Hospital, Raipur. 3.

Learned counsel for the applicant submits that no evidence is available against the applicant. He further submits that co-accused has been enlarged on bail in M.Cr.C. No.6169/2015 on 18/11/2015, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and submits that case of co-accused is different to that of this applicant and in

this case applicant has been identified.

I have perused the documents and the case diary. This applicant has been identified and from the applicant recovery of cash, pistol and 7 live cartridges were made. Considering the recovery made and this applicant has been identified and case of the present applicant is different to that of the co-accused who have been enlarged on bail, therefore this court is not inclined to release the applicant on bail. 6.

Accordingly, the bail application is dismissed. Certified copy as per rules.
