1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No.534 of 2014 registered at Police station Masturi, Distt. Bilaspur (C.G) for the offences punishable under Sections 4, 6, 10 of Chhattisgarh Krishi Pashu Parirakshan Adhiniyam.
2. As per the prosecution case, on 26.12. 2014, the applicant was transporting 50 cattles in a Truck bearing No.M.P. 018-18 G.A.1111 and another Truck No.U.P.78-CN/1867 and it was found that the Trucks were over crowded with cattle by tying their horns with a rope and one of the cattle was severely injured. It is alleged that the cattle were being taken to the slaughter house.
3. Learned counsel for the applicant submits that the charge sheet in this case has been filed and the applicant has been falsely implicated in this case and he is not owner of the Truck and cattle.
4. Per contra, learned State Counsel opposes the prayer for grant of bail and submits that against this applicant, 4 cases of similar nature vide Crime Nos.534/2014, 77/2015, 83/2015 & 104/2015 have already been registered against him and the applicant has repeatedly
committed the offence.
5. Perused the case diary and the statements of witnesses.
6. Considering the way in which the offence committed and further taking into fact that 4 cases of similar nature have been registered against the applicant within a close proximity of time in the years 2014 and 2015 and thus taking into the back ground of the past antecedents, I am not inclined to release him on bail, at this stage.
