Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/06/2017 This petition has been filed by the petitioner alleging willful disobedience of order dated 09/08/2016 passed by this Court in WPS No.3176/2016. 2.

Learned counsel for the petitioner submits that even though this Court had directed supply of necessary documents as demanded for inspection by the petitioner, the documents were not supplied and the authorities have proceeded to hold enquiry and passed order of termination of the petitioner. 3.

The documents which have been placed on record show that one of the allegation against the petitioner was that the petitioner himself is involved in unauthorised removal of official records. Learned counsel for the petitioner submits that the allegations are false.

The petitioner's allegation for supply of documents was considered but it was rejected on the ground that the documents are not available on record with the additional allegation that the petitioner is responsible and thereafter, final order

was passed.

Therefore, in this contempt petition, this aspect cannot be taken into consideration. The petition is finally disposed off. It would be open for the petitioner to challenge the order of the departmental enquiry as may be available to him under the law and revive contempt petition, if in case, the appellate authority or the higher authority records finding that despite availability of documents, the petitioner was not supplied with the same.
