Hon'ble Shri Justice Parth Prateem Sahu Order on Board 08/09/2021

1. Learned counsel for the appellant submits that issue of filing of proceedings for grant of anticipatory bail before High Court challenging the order of rejection of bail by Court below where offence under the Protection of Children from Sexual Offences Act, 2012 as well as under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is registered against accused, has been decided by Coordinate Bench of this Court in MCRC/3053/2020. In view of legal position, learned counsel for appellant seeks permission of this Court to withdraw this appeal at this stage with liberty to file application under Section 438 of Cr.P.C.

2. Prayer is allowed.

3. Accordingly, appeal is dismissed as withdrawn with liberty as prayed for.

4. Registry is directed to return back certified copy of impugned order dated 19.05.2021 to learned counsel for appellant after keeping photocopy of the same.
