On due consideration of the facts stated therein, the same is allowed. Delay in filing the Cr.M.P is hereby condoned. As arguable points have been raised by Learned Counsel for either side, in the opinion of this Court, it is a fit case where the Cr.M.P can be allowed.

Accordingly, the present Cr.M.P is allowed.
