1. Learned counsel for the petitioner submits that according to the new set up sanctioned for the school one Teacher from English, one Teacher from Hindi/Sanskrit, one Teacher from Maths, one Teacher from Science and one Teacher from Arts were sanctioned for the post of UDC. However, while
promoting the fellow teachers subject wise promotion was made and the petitioner was left out and eventually the petitioner was promoted on 15/02/2010 whereas the other persons have been granted promotion in the year 2008. Learned counsel submits that the petitioner's seniority should also be given from 2008. He would submit that the petitioner has filed several representations right from 2008, 2009 and lastly on 22/02/2013 to the Assistant Commissioner, Tribal Welfare, Korba, however same is not being decided. Therefore, the petitioner submits that he should have been granted seniority from 7/10/2008. Accordingly, the order of promotion be counted to that extent. He would submit that therefore representation of the petitioner may be decided.
2. Learned State counsel would submit that representation of the petitioner was way back given on 22/02/2013.
3. Considering the submission made, without any observation on the merits of the case, the petitioner is given liberty to file a fresh representation to respondent No.3, Joint Director, School Education Department, Bilaspur within a period of four weeks from today ventilating all the grievance and if such representation is filed, same would be decided within a further period of 45 days from the date of receipt of the representation. It is made clear that this court has not made any observation about the right of the petitioner.
