Heard on I.A. No.01 for condonation of delay in filing the MCC. For the reasons assigned in the said application and finding them to be satisfactory, I.A. No.01 is allowed and the delay of 396 days in filing the MCC stands condoned.

Also heard the MCC on merits.

It has been preferred seeking for restoration of M. A. (C) No. 224/2016 which got dismissed because of the peremptory order passed by this Court on 15.02.2016.

Consideration the total facts and circumstances of the case, particularly the fact that the appeal is on behalf of the claimants, this Court is of the opinion that it is a fit case to allow the application for restoration of M. A. (C) No. 224/2016.

Accordingly, the present MCC is allowed and M. A. (C) No. 224/2016 is restored to its original number.

No order as to costs.
