The limited relief that Petitioner seeks in the present Writ Petition is for an appropriate direction to Respondents to consider his claim for being absorbed in the regular establishment on the post of Attendant considering the length of services that he has rendered under the contingency establishment.

Contention of learned Counsel for Petitioner is that the Petitioner has completed more than 5 years of continuous uninterrupted services under the contingency establishment as an Attendant (Contingency Paid). The nature of duties discharged by Petitioner is exactly the same which is otherwise discharged by an Attendant of the regular establishment. That there are also posts available of Attendant under the Respondents.

Learned Counsel for Petitioner therefore submits that considering the length of services that Petitioner has put in and his services being satisfactory, the Respondents may consider his absorption under the regular establishment as an Attendant and for which the Petitioner has been repeatedly approaching the Authorities by making representations and also moving reminders of the same.

To this limited relief sought for by Petitioner, learned Deputy Government Advocate does not have any objection subject to the claim of Petitioner being considered in accordance with the rules, regulations and policy governing the field.

Considering the total facts and circumstances of the case, the present Writ Petition at this juncture is disposed of directing Respondents No.1 & 2 to take appropriate decision on the claim of Petitioner for absorption as an Attendant under the regular establishment of Respondents.

Let appropriate decision in this regard be taken by Respondents No.1 & 2 at the earliest, preferably within a period of four months from the date of receipt of copy of this Order.
