Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 19/11/2020 Heard.

The applicant has straightway filed the application for anticipatory bail before this Court without moving any application for anticipatory bail before the concerned Sessions Court.

Learned counsel for the applicant submits that extraordinary circumstances due to which applicant has directly approached this Court by passing normal remedy of applying for grant of bail before this Court are that the applicant is a Government servant; co-accused has been granted regular bail as he has a good case on merit.

Though there is no impediment in directly entertaining an application for grant of anticipatory bail before the Court, normal practice of first applying before the Session Judge should ordinary be followed. All that has been stated before this Court, in the opinion of this Court, do not make out an extraordinary case so as to allow the applicant to file anticipatory bail directly before this Court. The applicant may first approach the Sessions Court with the prayer for grant of anticipatory bail on such grounds which has been urged before the Court as also those available to him under the law.
