(2) Learned counsel appearing for the State/respondents submits that the impugned order dated 31.03.2016 of suspension of the petitioner is appealable before the appellate authority. (3) Learned counsel appearing for the petitioner submits that

he may be permitted to withdraw the instant petition with liberty to prefer an appeal before the appellate authority within three weeks from today.

(4) Prayer appears to be fair and reasonable.

(5) Accordingly, the petitioner is permitted to file an appeal before the appellate authority. If such appeal is filed by the petitioner before the appellate authority within a period of three weeks from today, the appellate authority shall consider and decide the same on its own merit and in accordance with law expeditiously from the date of receipt of appeal along with copy of this order.

(6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
