Hon'ble The Vacation Judge Order on Board 29/05/2017 1.

This petition is brought under Article 226 of the Constitution of India to direct respondent No.3/ the Regional Transport Authority to decide application dated 17.01.2017 and put a counter signature in favour of the petitioner.

The petitioner filed an application in respect of grant/renewal/ counter signature of the stage carriage permit on 17.01.2017. The attention has been drawn to notice dated 14.03.2017, in which, on serial No.29, the details of the petitioner have been mentioned. It is submitted that the name of

petitioner has been wrongly entered as 'Reena Gupta' whereas other details of the registration number of the vehicle and the number of permit are the same and the petitioner was directed to give appearance for submitting arguments on 17.04.2017. It is submitted that arguments were heard by the authority but counter signature on the permit has not been affixed so far. It is prayed that the authority may be directed to finalize the matter in accordance with law.

Learned State counsel submitted that he would not dispute the petition limited to the extent of prayer made.

Considering that respondent authorities have already heard the matter on 17.04.2017 and till date, the requested permit has not been issued to the petitioner with counter sign as required under the law and regulations. Hence, this petition is disposed of with a direction to the respondent authorities to consider and decide the petitioner's application at the earliest, preferably within a period of two weeks from the date of receipt of copy of this order.
