It is submitted by the counsel for the petitioner that the petitioner has been promoted and posted in capacity of Assistant Director, Directorate of Economic and Statistical, Naya Raipur by order dated 29.01.2016. After a lapse of 15 months, this order has been amended by order dated 24.05.2017, by which the petitioner has been transferred to Narayanpur to the post on which respondent No.3 was posted by order dated 29.01.2016 but who has not joined the post till date. This shows that this amendment of order has been made to accommodate respondent No.3 and penalize the petitioner.

Counsel for the respondents submits that the order dated 24.05.2017 has been passed under the authority of the respondents which cannot be challenged.

Looking to the facts and circumstances of this case, it would be appropriate to direct the respondents to consider on the representation made by the petitioner with respect to the amendment of transfer order made. The petitioner shall present a written representation to the respondents within a period of 15 days from today and the respondents No.1 & 2 are directed to consider on this representation further within a period of 30 days from the date of receipt of copy of this order. 4.
