Hon'ble Shri Justice P. Sam Koshy Order On Board 22.09.2021

1. The counsel for the petitioner submits that, during the course of the day, the petitioner shall remove the defaults as pointed out by the Registry.

2. The contempt petition has been filed alleging non-compliance of the order dated 23.03.2021 passed in WP(S) No. 995 of 2021.

3. On perusal of the pleadings itself it shows that subsequent to the disposal of the writ petition, the respondents vide Annexure C/3 dated 15.06.2021, after consideration of the claim of the petitioner, have rejected his representation. The fact that this Court had only directed

the respondents to take an appropriate decision and the respondents have now taken a decision vide Annexure C/3 dated 15.06.2021. This Court is of the opinion that the order passed by this Court stands complied with. Whether the order C/3 is proper, legal and justified is one which can be tested only by way of a fresh petition, the veracity of the same cannot be tested exercising the contempt jurisdiction of this Court.

4. Reserving the right of the petitioner for availing the said remedy, the contempt petition stands rejected.
