1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.129/2020 registered in Police Station Nagarnaar, District Bastar for offence under Section 20 (B) (II) C of the NDPS Act.

2. The first bail application was dismissed without reserving any liberty. However, the applicants are in jail since 14.8.2020 i.e. for the last more than 13 months. They were found in illicit joint possession of 21 kg of Ganja.

3. Learned counsel for the applicant submits that conclusion of trial may take some more time and if the recovered quantity of contraband Ganja is divided between the applicants, it would be less than the commercial quantity.

4. Learned State Counsel would oppose the prayer for grant of bail. However, he submits that the concerned SHO has not reported any previous antecedents of the applicants.

5. Considering the entire fact situation of the case, particularly the length of pre-trial detention, I am inclined to release the applicants on bail.

6. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court.
