Shri Ghanshyam Patel, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/06/2017 The aforesaid ground raised in this petition is to invoke Court's indulgence on personal grounds and festivity.
During the course of arguments, learned counsel for the petitioner emphasizes on the submission that as this is a rainy season, it would be very difficult to vacate the quarter and he and his family would suffer hardship. The petitioner is no longer in service, having been terminated on account of his conviction. The order of termination was passed on 22/08/2014. The petitioner is already enjoying possession of the quarter without any authority for the last almost three years. Therefore, keeping in view the aforesaid aspect, it would be proper to grant the petitioner another 30 days to vacate the quarter, failing which, respondent authorities within their competence and authority shall take action.
