Hon'ble Shri Justice Goutam Bhaduri Order 02.11.2020 Heard.
1. Learned counsel for the petitioner submits that since two posts of District Excise Officer are lying vacant because officers namely Shri Satyendra Kumar Jain and Shri Surendra Pratap Singh have retired and one Shri D.K. Rathore has died wherein the petitioner can be accommodated by way of promotion. The limited prayer of the petitioner is that considering the age of the petitioner that he is aged about 61 years and is going to retire in September, 2021, he prays that he may be considered for the promotion. He further submits that the promotion list which was issued would expire in the month of December, 2020. Consequently, the petitioner has made a representation (Annexure P-4) and he prays that the representation may be directed to be decided and accordingly he may be promoted.
2. Perused the representation Annexure P-4, which has been submitted by the petitioner. Considering the same without any observation on the merit, the respondents are directed to decide the representation of the petitioner
objectively according to the existing rules for promotion within a period of 30 days from the date of receipt of a copy of this order.
