Heard on I.A. No.01, an application for grant of ad-interim bail to the applicant.
The applicant is apprehending his arrest in connection with Crime No.106/2018, registered at Police Station- Azak, Surajpur, DistrictSurajpur (C.G.) for the offence punishable under Sections 302 and 201 of Indian Penal Code and Section 3(2)(5) of Scheduled Caste/Scheduled Tribe (Prevention of Atrocities) Act.
Learned counsel for the applicant submits that the marriage of the real sister of the applicant is scheduled from 12.07.2019 to 16.07.2019 in which the participation of the applicant is very necessary on account of social reasons. Therefore, prayed that he may be granted ad-interim bail. Learned counsel for the State opposes the application. Earlier, the first application filed by the applicant was rejected on merits, thereafter, the second application filed was dismissed as withdrawn and the third application filed by him was disposed off at motion stage. Therefore, it is clear that this applicant is not entitled for grant of regular
bail. However, on account of the reasons mentioned in the application for grant of ad-interim bail that the real sister of the applicant is getting married and for social reasons his presence is required. Therefore, only on the ground of humanity, I feel inclined to allow this application. Accordingly, I.A. No.01, an application for grant of ad-interim bail is allowed.
It is ordered that the applicant shall be released on bail on temporary basis on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like sum to the satisfaction of the trial Court and the applicant is required to surrender on or before 18 th July, 2019 before the concerned Court.
The main petition for grant of regular bail is also disposed off. Certified copy today.
